Terms of Service

• “Wheelhouse,” “we,” “us” refers to the operator of the Wheelhouse platform.
• “Service” means the Wheelhouse website, mobile apps, APIs, and related software.
• “Host” means a user who lists a trailer or RV for rent on the Service.
• “Guest” means a user who books or attempts to book a listing.
• “Listing” means a description of a Trailer offered for rent through the Service.
• “Booking” means a confirmed reservation for a Listing.

Wheelhouse is a venue. We provide software that lets Hosts offer Trailers and lets Guests find and book them. We are not a party to the rental agreement between a Host and a Guest. We do not own, operate, lease, or control any Listing.

We do not endorse any Listing, Host, or Guest, and we don't guarantee the accuracy of any user-provided content. We do enforce community standards, remove listings that violate them, and operate trust & safety processes described in the Safety page.

You must be at least 18 years old and legally able to form a binding contract to use the Service. You agree to provide accurate information when registering and to keep that information current.

You are responsible for safeguarding your password and for all activity under your account. Notify us immediately if you suspect unauthorized use.

We may verify your identity, including by collecting government-issued ID through Stripe Identity. We may refuse, suspend, or terminate accounts at our discretion, including for repeated policy violations, fraud, or safety concerns.

If you list a Trailer, you are the owner or you have the authority to rent it. You will:

• Provide accurate descriptions, photos, dimensions, capacities, and rules.
• Maintain the Trailer in safe and habitable condition.
• Comply with all applicable laws — including local short-term-rental ordinances, RV park rules, and tax registration requirements.
• Carry appropriate insurance for short-term rental of an RV or trailer in your jurisdiction. See Insurance.
• Honor confirmed bookings, except when an extenuating circumstance applies.
• Communicate with guests through the Service rather than steering them off-platform.

You grant Wheelhouse a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your Listing content for the purpose of operating and promoting the Service.

When a Guest books a Listing, they enter into a rental agreement with the Host. Wheelhouse facilitates the booking and acts as the limited payment-collection agent of the Host for the purpose of accepting payments from Guests on the Host's behalf.

• Guests authorize their payment method at the time of booking. Funds are captured when the Host confirms the booking; for instant-book listings, capture happens automatically.
• Host payouts are released through Stripe Connect on the schedule the Host has selected, subject to clearing times.
• Wheelhouse charges a guest service fee and a host fee on each booking. Current fee percentages are documented on the About page and shown at checkout.
• Taxes are computed from the Listing location and added at checkout. Hosts are responsible for any local lodging or transient-occupancy taxes that aren't collected by the platform.
• Refunds and cancellation handling are governed by the Cancellation policy.

You agree not to:

• Use the Service for unlawful, fraudulent, or harmful purposes.
• Submit listings that are inaccurate, misleading, or designed to evade taxes or regulations.
• Harass, threaten, dox, or discriminate against any user. Discrimination on the basis of race, color, national origin, religion, gender, gender identity, sexual orientation, age, marital status, disability, or other characteristics protected by law is prohibited.
• Circumvent the platform to take payments off-app or contact users for non-trip purposes.
• Attempt to reverse-engineer, scrape, or otherwise compromise the Service.
• Use the Service to host parties or events not disclosed on the Listing.

Violations may result in listing removal, account suspension, or permanent termination at our discretion.

You retain ownership of content you submit. You grant Wheelhouse a worldwide, non-exclusive, royalty-free license to use, display, store, copy, and create derivative works of that content for the purpose of operating and promoting the Service.

Reviews are tied to completed bookings, must be honest, and must not be exchanged for compensation. Wheelhouse may remove reviews that violate community standards but will not remove reviews simply because they are unfavorable.

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Wheelhouse disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that any Listing will meet your expectations, that the Service will be uninterrupted or error-free, or that any defects will be corrected. Decisions about whether to enter a rental agreement are yours alone.

To the fullest extent permitted by law, Wheelhouse will not be liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the total fees you paid Wheelhouse in the twelve months before the event giving rise to the claim, or (b) USD $100.

You will indemnify and hold harmless Wheelhouse, its officers, directors, employees, and agents from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your Listings or Bookings, your violation of these Terms, or your violation of any rights of a third party.

Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except for small claims and certain equitable relief. You waive the right to participate in a class action or class-wide arbitration.

You may opt out of this arbitration provision within 30 days of first agreeing to these Terms by emailing legal@getwheelhouse.com with your account email and the words “arbitration opt-out.”

You may close your account at any time. We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or for any other reason. Sections that by their nature should survive termination (limitation of liability, indemnification, disclaimers, dispute resolution, miscellaneous) survive.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration provision. Venue for non-arbitrable disputes is the state and federal courts in San Francisco County, California.

We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 30 days before they take effect. Continued use of the Service after changes go into effect constitutes acceptance.
